EVENT TERMS & CONDITIONS


Your decision to register for the Flamenco Guitar Course organised by Online Flamenco constitutes your acknowledgement of and consent to all of the terms and conditions listed below. Please read them carefully before finalising your registration.

1. Definitions 

“Agreement” means these Event Terms and Conditions, together with the information provided at the Event Page.


“Attendee” means the student enrolled to attend the Event.


“Event” means the Flamenco Guitar Course organised by Online Flamenco, as more fully set out on the Event Page.


“Event Page” means the Online Flamenco promotional page reflecting the program description, prices and FAQ regarding the Event, available at https://onlineflamenco.com/come-to-cordoba-main.

 
“Course Info Page” means the program content description, location, timetables, updates and other relevant information regarding the Event, available at https://onlineflamenco.com/come-to-cordoba-info.

 
“Form” means the Event enrolment form the Attendee is required to complete in order to register for the Event, available at Secure Checkout :: Online Flamenco Academy (Main Products) - Come To Córdoba Event Ticket (1 person - Early Bird) (paykickstart.com)


“Location” means the location as specified on the Course Info Page, available at https://onlineflamenco.com/come-to-cordoba-info/


“Organiser” or “Online Flamenco” means Online Flamenco VOF, a Dutch company registered with the Chamber of Commerce in the Netherlands, with registration no. 81770030

 
“Services” means any services provided by Online Flamenco to the Attendee under this Agreement.

2. Services

2.1 Unless mentioned or agreed otherwise, the Agreement becomes valid after the Attendee has submitted the Form.


2.2 Online Flamenco will perform the following Services with regards to the Event:
Online Flamenco organizes this event to offer the opportunity for students to experience authentic traditional flamenco as specified on the Course Info Page through a four day program with 4 hours of lessons per day and activities and services that include but are not limited to planning, organising and executing the Event, creating the Event program, determining the timetable, length and structure of the guitar lessons, arranging attendance of live flamenco shows, selecting appropriate venues and locations for the Event, organising excursions and other activities and making necessary modifications to any component of the Event. Online Flamenco is exclusively responsible for the organisation and execution of the event and not for accommodation, transportation or any travel documents that are required to attend the event.


2.3 Online Flamenco will provide the following deliverables with regards to the Event:

    • 3 hours of daily live morning training lessons with an Online Flamenco Maestro, including teaching, feedback, guidance.
    • 1 hour of daily live afternoon repetition classes with a professional guitarist.
    • Daily recordings and access to these recordings after the event.
    • Welcome meal on the first day.
    • Goodbye dinner on the last day.
    • Access to all performances and live shows
    • Certificate of attendance (hereinafter the “Deliverables”)


2.4 Attendees are required to bring their own musical equipment, and are responsible for storing and maintaining it during the Event.

3. Payment

3.1 Unless mentioned or agreed otherwise, the Attendee is obliged to pay Online Flamenco the total sum as stated on the Form, upon registration.


3.2 The total sum communicated on the Online Flamenco website is considered to be the price per person, unless otherwise indicated. 


3.3 The total sum is based on the prices, values, rates and taxes as known to Online Flamenco on the day of enrolment.


3.4 When the Attendee makes a payment in a currency different from the Online Flamenco’s currency, a surcharge to cover costs for currency exchange may apply, which will be paid by the Attendee.

4. Flamenco Guitar Course, accommodation and activity program

4.1 Unless stated otherwise, the minimum number of participants to confirm the event is 10 people. In the event, this required minimum is not reached, Online Flamenco is entitled to cancel the Event and terminate this Agreement, by giving the Attendees at least 30 days advance notice before the Event commencement date, and will issue refunds in full to all Attendees.


4.2 Online Flamenco has the right to determine and change the timetable of the lessons, excursions, locations, course dates, tutors and activities for reasons such as non-availability of venues, insufficient take-up of the relevant course, and sickness or other absence of tutors. Online Flamenco will give as much notice and explanation of any such change as is reasonably possible and, where practicable.


4.3 The costs of travel, accommodation, meals and drinks are not included in the course price, except where specifically stated on the Course Info Page, and each Attendee is solely responsible for covering their own expenses during the Event.


4.4 The Attendee is obliged to follow the accommodation rules provided by Online Flamenco and any other accommodation provider. These rules may include but not be limited to not being allowed to bring over visitors or practice guitar at certain hours.


4.5 When the Attendee arrives late or is absent on a day of the Course, being justifiable or not, there will be no refund nor compensation with a free extension of the Course.


4.6 When at the Location, or any other premises during the course of the Event, the Attendee will behave appropriately at all times and in such a manner as not to cause a nuisance, injury or damage to other persons (in particular, other Attendees, Online Flamenco employees, contractors, and any visitors) or to any property. Online Flamenco will not be held liable for the Attendees actions or behaviour during the Event.

 
4.7 In case of a serious disciplinary offence, including but not limited to repeated bad behaviour, infringement of the law, violation of the code of conduct within the venue reserved through Online Flamenco, the Attendee will be expelled from the venue contracted through Online Flamenco without the right to any refund, and within the sole discretion of Online Flamenco, may be expelled from the Course and prohibited from attending the Event. Any damages will be charged to the Attendee.

5. Travel documents and insurance

5.1 Should an Attendee need to travel internationally in order to attend the Event, the Attendee is solely responsible for obtaining the correct travel documents, VISAs, and arranging sufficient insurance.

6. Amendments and cancellation by Online Flamenco

6.1 All Event reservations and payments are final. Online Flamenco does not offer refunds, either full or partial, except as expressly set out in 4.1.


6.2 Neither party shall be in breach of its obligations under this Agreement or incur any liability to the other party for any delay or failure to perform its obligations hereunder if and to the extent such delay or non-performance is caused by acts, events, omissions or accidents beyond a party’s reasonable control, including, without limitation, strikes, industrial disputes, failure of a utility service or transport network, acts of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of machinery, act of terror, Internet service provider failure or delay, denial of service attack, fire, flood or storm (each a “Force Majeure Event”).


6.3 If Online Flamenco is affected by a Force Majeure Event, it will use all commercially reasonable endeavours to modify the Event switching the Course from a live to an online one. Notwithstanding the above, Online Flamenco reserves the right to terminate the Agreement without any liability and no obligation to refund the Attendee.


6.4 Online Flamenco can amend the Agreement at any time. In such an event, it is obliged to communicate this promptly in writing, including a cause where practicable, to the Attendee.

7. Liability, complaints and disputes

7.1 Online Flamenco’s total liability to the Attendee in respect of breach of contract or breach of duty, tort or fault or negligence or otherwise whatsoever and/or howsoever arising out of or in connection with this Agreement shall be limited to the full sum paid by the Attendee to the Organiser for the Event.

 
7.2 Except as set out herein, and to the extent permitted by law, Online Flamenco shall under no circumstances be liable to the Attendee, whether in contract, tort or otherwise, for any indirect or consequential loss arising hereunder or in connection with the Services provided by Online Flamenco under this Agreement (including without limitation, travel, accommodation, or any ancillary expenses).

 
7.3 Online Flamenco shall not be liable for any loss or termination hereunder resulting from or arising in connection with any Attendee’s visa status or other reason related to immigration matters.


7.4 Online Flamenco cannot be held responsible for any illnesses, accidents, loss or damage to personal property suffered by Attendees during the Event.


7.5 In case of a complaint or dispute by the Attendee regarding any of the Services offered, Online Flamenco should be contacted immediately, or at least within 24 hours. Online Flamenco will use reasonable efforts in trying to resolve any complaint or dispute. In case the Attendee is at the event location, the Attendee should contact the local Online Flamenco staff. If the local staff doesn’t resolve the complaints, the Attendee is obliged to contact Online Flamenco via email. If Online Flamenco isn’t contacted within reasonable time by the attendee, Online Flamenco cannot be held responsible after the course finishes.

8.  Intellectual Property and protection of data

8.1 Online Flamenco reserves the right to use all possible photos and videos taken during the Attendee’s stay unless the Attendee declares otherwise in writing via email before the day of arrival at the Event.


8.2 All pre-existing intellectual property rights should remain the exclusive property of the respective parties and shall not be transferred or affected by this Agreement. Any new intellectual property created or developed during the Event shall be owned by the creator(s) of such intellectual property, subject to the provisions outlined in this Agreement.

 
8.3 All Intellectual property (including without limitation registered design, copyright, database right, trademarks, application to register any of the aforementioned rights, trade secrets and/or know how) in Online Flamenco materials, courses, presentations, documents, or other work product created by Online Flamenco shall remain the exclusive property of Online Flamenco or its licensors.


8.4 Attendee agrees to take reasonable measures to protect Online Flamenco’s intellectual property rights from unauthorized use, copying, or distribution. In the case of any unauthorized use or infringement of intellectual property, the infringing party shall be responsible for any damages or losses incurred by the Organiser.


8.5 In compliance with EU Law 2016/679, regarding the protection of personal data, the Attendee’s data will be stored and processed in a database owned by Online Flamenco, solely for the commercial and operative purpose of Online Flamenco.

 
8.6 Unless you explicitly express otherwise, Online Flamenco may use your personal data to keep you informed of news and developments related to the services.


8.7 The Attendee has the right of access, rectification, cancellation and opposition of the personal data by email or by letter to the address mentioned on the website, accompanied by photocopy of a personal ID card.

9. Governing Law and Jurisdiction

9.1 This Agreement shall be governed by and construed in accordance with the laws governing the Netherlands.  Each Party irrevocably agrees that Dutch courts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement, including but not limited to non-contractual disputes.
